The Anticipatory Breach of contract theory is considered a deviation from traditional rules.
It is inspired from the Anglo-Saxon system as it gives the creditor the right to disaffirm the contract before its implementation deadline.
It also gives the contractor the right to claim compensation for the incurred damage whenever the debtor expresses unwillingness or inability to implement his/her commitment to the deadline.
The 1980 Vienna Covention on Contracts for the International Sale of Goods adopted this theory, as stipulated in the 2002 US Unified Trade Act.
