The non-profit organization is considered to be one of the new companies covered by the Palestinian, Jordanian, and Kuwaiti legislators.

This research defines the concept of the non-profit organization and specifies its basic features.

The non-profit organization is a type of commercial companies that has an independent legal personality separate from the legal personality of partners.

It has the capacity to acquire the rights and assume the obligations.

Moreover, the financial liability is independent of shareholder’s liability, and the liability of the partners is limited.

Besides, the research draws a comparison between non-profit companies and other similar legal entities, especially commercial companies, civil companies and charitable associations.

It also shows that the non-profit company has been governed by the company law and may have one or more type of commercial companies but its goal is not to achieve profit.

In contrast, the non-profit company basically aims to achieve social and developmental goals; goals that give it a special legal nature that distinguishes it from other similar legal entities.
