The financial intermediary plays an important role as a professional person who executes the sale and purchase orders to investors in the stock market.

His work consists in mobilizing investors’ funds in these markets, revitalizing and reactivating the movement of the national economy in order to attract investment.

The breach of the financial intermediary of his legal and contractual obligations has serious dimensions.

The search for a solution is indispensible, especially in view of the inadequacy of general rules in civil liability for the protection of investors as well as the rules of litigation, in addition to the absence of effective rules of protection in the law of the Securities and Commodities Authority.

Therefore, we have found that the insurance system of the responsibility of the financial intermediary is an effective means to achieve protection and to create investment security and confidence in the market, which will bring investment and create economic and social stability, provided that such insurance shall be compulsory.

The research was divided into two sections: the first section discussed the pillars of organizing the insurance contract from the responsibility of the financial intermediary, while the second discussed the grounds for compulsory insurance of the responsibility of the financial intermediary.

In conclusion, we highlighted the main findings and recommendations.
