Abstract EN

This research deals with the issue of the adequacy of prohibiting the abuse of the dominant position in the Emirati law and European competition law, through examination of the latest legislative developments in this field, with a view to ensuring that the UAE trade legislation is consistent with the WTO agreement and removing any conflict with it.

The study also refers to the merger and acquisition concession, and distinguishes between them.

Finally, we concluded with our findings and recommendations that we believe will ensure the effectiveness of trade agreements, the most important of which is the great similarity between the legal framework in the UAE regarding restrictive practices and EU legislation, despite its primacy in this area, except for minor differences.

The researcher recommended the preparation of a database of new practices that restrict competition in the light of the development of economic activity in the UAE market, in addition to constantly updating and developing them to serve the work of the Authority in all areas related to the organization of competition.
