Abstract EN

In the context of maritime transactions it became necessary to enter a maritime broker , or as he is known as a maritime broker , wich performs reconciliation and rapprochement between the two parties to the contract , as mediating between the supplier and the shipper in the marine transport contract, or between the insured and the insurer in the marine insurance contract .

The Algerian legislator stipulated in Article 631 to 638 of the maritime law the maritime broker , and explained through the aforementioned articles the duties and obligations of the maritime broker , based on an agency contract to be writen .

It is also evident to us by presenting the duties and obligations of the broker to try to give the legal relation between the ship’s agent and cargo agent and maritime broker , in wich the forms were raised , as we find that the algerian legislator explicitly stipulated in article 638 of the maritime law , that the maritime broker shall undertake the operations related to the safety of the ship and the safety of the cargo accordingly, the provisions of the ship agency and the cargo agency apply to him, as for the responsability, the maritime broker is responsible for his personal business.
