Abstract EN

The right of passage to the owner of the confined land, totally or partially, by public road, is a legal restriction established by the force of law.

It is granted when the legal conditions are fulfilled, in exchange for compensation for damage to the neighboring land, in view of the inkind charges that falls on it, unless the restriction is the result of the will of the owner himself, or is granted to him by way of agreement or tolerance.

The right of passage is subject to its acquisition by statute prscripition, as it extinguishes the same as the easement rights as a general rule in legally defined cases.
