Abstract AR

الحيازة وضع مادي يرتب عليه القانون آثارا هامة أبرزها كسب الحقوق بالتقادم المكسب، غير أن القانون يحمي الحيازة لذاتها برصف النظر عن الحق لاعتبارات و مبررات عدة، أهمها حماية الأمن و السلم الاجتماعي.

لكن التشريعات مختلفة و متباينة في تنظيم أحكام حماية الحيازة لأسباب تاريخية و فلسفية ترجع في أغلبها إلى التجاذبات الفلسفية التي تؤسس عليها التسريعات أحكام الحماية، الأمر الذي انعكس على القضاء الذي يواجه صعوبات عملية أثناء الفصل في منازعات الحيازة.

و من أجل مجابهة و حل تلك الصعوبات استحدث الفقه و القضاء و التشريعات المقارنة حلولا مختلفة لتلك الصعوبات تتميز بتنوعها و تفاوتها من حيث فعاليتها .

Abstract EN

In order to take into account of the apparent reality and to preserve the established order and social peace , the law protects the possession and transforms it from a simple materiel mastery into a legal situation endowed as such with a particular protection.

However in addition to doctrinal controversies, this protection gives rise to many practical difficulties when exercising possessory actions before the various jurisdictions.

To deal with it, many distinct solutions have been introduced both by jurisprudence and by contomporary legislations.

Pour tenir compte de la réalité apparente et préserver l’ordre établi et la paix sociale le droit protége la possession et la transforme d’une simple maitrise matérielle en situation juridique dotée en tant que telle d’une protection particulière.

Or cette protection suscite outre les controverses doctrinales de nombreuses difficultés pratiques lors de l’exercice des actions possessoires devant les différentes juridictions.

Pour y faire face, de nombreuses et distinctes solutions ont été introduites tant par la jurisprudence que par les législations contemporaines.
