Abstract EN

This research deals with the criminal liability imposed on a patient infected with Coronavirus when he intentionally transmits the infection to other individuals, which varies according to the result that resulted from transmitting the infection to a healthy person with his knowledge and will, in accordance with the provisions of Jordanian law.As this research deals with the position of the Jordanian legislator in its various laws regarding the acts used by the vector of this virus as a means of transmitting it to others with the aim of exposing them to the risk of infection, whether intentionally or by mistake, and looking for the extent of the criminalization of these texts for these acts committed by reviewing the provisions of the penal laws related to With regard to the crimes of murder and abuse and the attempt to apply them to acts of transmission of the emerging corona virus, as it did not independently determine responsibility for transmitting the disease.The study finally concluded with a set of findings and recommendations, the most important of which is the need to amend the Jordanian Penal Code and the Public Health Law so that this disease is included in the list of communicable diseases, and criminalize its transmission as an independent crime if it is intended to harm or kill others, and that the criminal intent to establish the crime and be punished for it is sufficient.
