Abstract EN

The research deals with a contentious jurisprudential topic between old and modern Islamic jurists: Al Noqoot (gift- giving in occasions), should it be returned back, substituted, or not.

The two researchers dealt with the subject by linking it to a jurisprudential issue which the ancient jurists dealt with; the gift for reward.

The importance of the subject stems from its impact on the society.

Quite often a dispute arises about Noqoot, whether it should be returned or not, especially when a disputel occurs between the two parties.

It turns out that the Noqoot is similar to the gift for reward according to those who considered it as a loan and obligatory to return it, so it takes its rulings.

The two researchers have suggested that in terms of Noqoot; to return it back or not, depends on is habits and customs, so according to the customs, it can be returned or not.

The researchers assures that it is better for a person to be rewarded for the present, the gift and Noqoot, as the Prophet, may Allah bless him and grant him peace, used to do.
