Abstract EN

There is no doubt that the mandate of the state jurisdiction on waqf (Islamic endowments) has an important role in promoting waqf as a mean of charitable expenditure and in achieving effective protection for the waqf and its development.

This reflects the importance of studying the judicial control over the waqf taking into consideration that the state judiciary represents justice.

The verification of Waqf upon completion or considering many issues related to its administration and its connected rights from the state judiciary seems to prevent its completion or any action related to it, which contradicts the provisions of Islamic law dictated by the Jordanian law.

The current study aims to determine the reality of the Jordanian judicial supervision on Waqf and its related issues addressing the Jordanian legislation and the rules prescribed in the Islamic jurisprudence.

This leads to highlight the authorized role of jurisdiction on the waqf in a comprehensible and clear way.
