اللغو واقع في النذور والأيمان والعقود والطلاق والإقرارات، ويقصد به سبق اللسان باللفظ دون قصد، ويتجه هذا البحث إلى التعريف بلغو الأقوال، والتفريق بين اللغو والخطأ والهزل ونحوها من المعاني ذات الصلة، ثم إلى دراسة الأثر الذي ينجم عن التلفظ بالصيغة الشرعية على سبيل اللغو، لا على سبيل القصد والإرادة، سواء في المواطن الأخروية أو الدنيوية، وبين الباحث أن الخلاف بين العلماء محصور في المؤاخذة الدنيوية، وبين ما يترتب عليه من الخلاف في مسائل متعددة، وانتهى الباحث إلى أن من تكلم بكلام لغو دون أن يقصده غير مؤاخذ بما يقول ديانة، ويصدق قوله في الفتيا دون بينة، فلا يكلف الكفارة في اليمين، ولا يلزم بالنذر إذا جرى على لسانه دون أن ينويه، ولا يثبت في حقه الطلاق، كذلك ينتهي الباحث إلى ما ذهب إليه فقهاء المذاهب الأربعة من كون دعوى اللغو والخطأ غير مقبولة قضاء، ويؤاخذ المتكلم بما يقول بناء على الظاهر، مالم يدل دليل على خلاف ذلك، وبذلك يظهر الفرق بين حكم اللغو ديانة وحكمه قضاء، وهو الغاية من البحث.
Abstract EN
Idle words can be uttered in vows, oaths, contracts, divorce, and declarations.
It refers to uttering a word unintentionally.
This paper defines idle words and makes distinction between idle words, mistakes, joking and relevant senses.
It examines the implications of the uttering Shari’ah-related words idly, not intentionally, whether about worldly matters or about the hereafter.
The author showed that the different opinions of scholars are only related the worldly matters.
He also explored the implications of the different arguments in many issues.
Then he concluded that whoever utters idle words unintentionally is not accounted religiously and his words are taken into consideration without the necessity of producing evidence.
He is not required to expiate for his vow or oath if he did not mean what he said, neither is his divorce valid.
The author also confirms the opinions of the four schools of Fiqh about the invalidity of idle words in law.
The speaker should be accounted for his outward, unless we notice something different.
Accordingly, we can differentiate between the ruling of idle words in faith and law.
