In order for the public utilities to operate regularly and steadily, most countries have granted the administration to impose various penalties on the contractor who fails to perform his work with them, and they are of four types.
It aims to force the defaulting contractor to correct his wrong course and abide by the contract concluded between him and the administration and it is considered one of the serious penalties and is represented in placing the project under guardianship in the commitment contract, in withdrawing the public works contract from the defaulting contractor, and in buying at the expense of the defaulted supplier, and the third are the overriding penalties.
Which are considered more dangerous than the previous penalties, which will be dealt with in special research for their importance and seriousness, because they set a watershed and termination of the administrative contract, and the fourth type of penalties is criminal sanctions, which is a concept independent of itself from the rights and powers of the administration based on contractual obligations.
Finally, our personal position on these sanctions has been clarified.
