Abstract EN

The study of terminology is considered as one of the prominent scientific studies through which the researcher stands on the manifestations of the term under study to reach out its meanings and purposes.

This way, he builds up scientific foundations for a sound knowledge structure.

One of these terms is the Arabic one «Al Maskhoute” which is used frequently in the books of jurisprudence in particular, both the reader and the researcher are inclined to look for its meaning and purposes at the linguistic, customary, legal and doctrinal levels.

At the linguistic level, the word means anger, hatred, and dissatisfaction according to popular language sources like “Jamharate” Ibn Dourayde, Al Fayrouzabadi dictionary, and Al Razi’s Sihah.

The closest meaning to the term is based on the Quran and the prophet’s Sunnah where the term “Sokht” means anger and dissatisfaction as a characteristic, lecherous and cursed as a character.

On the other hand, the usual customary significance of the term, according to its use in our country, is closely related to the legal definition.

Thus, “Al Maskhoute” is the one cursed and hated by his parents to the extent that such hatred reached the level of disobedience, it also defines a sly cunning person.

In jurisprudence and particularly in the Maliki doctrine, the term defines a man whose testimony and credibility has been dropped.
