Abstract EN

The study aimed to show that the causal evidence of the description and the evidence for its confirmation are the two pillars of the legal rulings, as every legal ruling must have evidence of its legitimacy from the Book, the Sunnah, consensus, and analogy, and evidence of its proof must be based on custom and experience.

The aim of this research is to find out the evidence of the causal description and the evidence for its proof according to the fundamentalists.

Evidence for causation of description and evidence of its confirmation are of great importance, so through causation of description, the legitimacy of the ruling is known from the necessity, permissibility, sanctity, dislike, and others.

Through the evidence, the occurrence of the facts that are the subject of judgments is known.

The problem of the study is to clarify the difference between the evidence of causal description and the evidence of its proof according to the fundamentalists.

One of the most important objectives of the research is to clarify that the evidence for causal description is limited evidence and derived from the revelations of the Book and the Sunnah, while the evidence of confirmation is related to experience, custom, lottery, testimony and other evidence, and therefore they are unconfined and renewable evidence.

The study relied on the inductive-analytical approach by referring to the mothers of the books of Usual al Fiqh, hadith, language and modern references to provide scientific material related to the subject.

The study concluded with several results, including the knowledge of the evidence for causal description and the evidence for its proof according to the fundamentalists, which helps the judge in his judgment, the mufti in his fatwa, and the jurist in his jurisprudence.
