Through this research paper, we touched upon the administrative penalty in general and the environmental administrative penalty in particular, as it is the subject of the study in terms of definition and the basic stages of its development since the emergence of administrative law in France, in addition to the basic characteristics of the environmental administrative penalty and its participation with other administrative sanctions in terms of its issuance By a public authority, its generality, in addition to its deterrence, and then defining the scope of administrative sanctions and their relationship to the environment, which leads us to define the concept of the environment, its elements and the scope of its protection.

And this is what prompted us to raise the problem: To what extent did the Algerian legislator grant the administration the authority to impose administrative penalties in the field of environmental violations? In order to present this problem, we aim to achieve the objectives represented in: Determining the effectiveness of the environmental administrative penalty and clarifying the stages it is going through, adopting for this purpose a systematic approach that combines description and analysis of the various jurisprudential opinions and legislative texts related to the subject.
