Due to different considerations, the outcomes of the industrial and technological evolution have rendered the traditional civil responsibility powerless to ensure a fair and an adequate indemnification of the victim.

indeed, it is hard to prove or appreciate the environmental damages such as the casualties of environmental pollution that are caused by industries including their emissions and noise.

the environmental casualties often stem from legal activities which conform to the laws.

besides, such casualties are indirectly caused by no one single factor but many.

therefore, to assure the victim's right to indemnification as the law stipulates, environmental damage funds have been established.
