Abstract EN

This study aims to treat an importance issue in the administrative law, this latter assesses the Algerian experience in applying the franchise type as a mean to pave the road for the private sector to direct and manage the public facilities, since the franchise contract is one of the main delegations contract of the public facility that it is taken by Algeria in order to administrate the economical or administrative public facilities, especially the economical one.

In this research, we reached that the franchise contract is considered an indisponsible type which permits the private sector to be involved, however and in reality, we found it as an obstacle against the public sector in Algeria, From the results of our survey, we gave some prepositions which strengthen the apply of the Algerian experience of such a contract because of its positive implications for supporting the partnership between the both sectors.
