Exemption from religion is one of the issues that Muslim jurists have taken care of and dealt with by various man-made legislations, including the Algerian legislation, for which Articles 305 and 306 of the Civil Code are devoted to talking about the nature of this behavior, its features, conditions, types, and the effects resulting from undertaking it.

Therefore, this research paper came to unveil the subject of the provisions of the exoneration of religion in a study between the provisions of Islamic jurisprudence and Algerian legislation.
