The Child enjoy special legal protection through the various international conventions ratified by the Algerian state and the laws created by the legislator at the same time.

However, there is a category of children who are the weakest and most in need of protection, and they are the orphans.

And from that, we discussed the issue of the legal status of orphans in Algerian law through the Algerian Nationality Law and the Family Law to know the mechanisms established by the Algerian legislator to protect orphans, as well as to ensure the orphan child and his enjoyment of his legal rights during this legal procedure and what are the shortcomings in this legal system set by the Algerian legislator.
