نتناول في هذه الدراسة المجلس الوطني للاستثمار، و ذلك بتسليط الضوء على ما جادت به النصوص القانونية المنظمة لسير و أداء هذا الجهاز.
محاولين التطرق و معالجة مختلف الجوانب المتعلقة بها سواء من الناحية النظرية أو العملية.
توصلنا إلى أن الرؤية القانونية لهذا الجهاز، تضعه في خانة جهاز بمثابة مجلس حكومة مصغر، و مانحة لها أدوار خاصة منها ما يتعلق بترقية مناخ الاستثمار بوجه عام، و أخرى تخص الاستثمار الأجنبي.
إلا أن الواقع العملي أثبت أن دور المجلس يظل محدود في سبيل ترقية الاستثمار.
Abstract EN
In this study, we address the National Investment Council, by highlighting what the legal texts regulating the functioning and performance of this device have found.
Trying to address and address various aspects related to it, whether in theory or in practice.
We have come to the conclusion that the legal vision of this body places it in the category of an apparatus as a mini-government council, and a donor with special roles, including those related to the promotion of the investment climate in general, and others related to foreign investment.
However, the practical reality has proven that the role of the Council remains limited in order to promote investment.
Abstract FRE
Dans cette étude, nous présentons le rôle confié au Conseil National de l'Investissement dans le domaine de la promotion et du développement de l'investissement, en mettant en exergue ce qu'énoncent les textes légaux réglementant les performances de cet organisme.
Tout en abordant divers aspects liés à cela, à la fois en théorie et en pratique.
Nous avons conclu que les textes juridiques réglementant cet organisme se sont vu attribuer plusieurs rôles afin de promouvoir l'investissement, notamment ceux liés à la promotion du climat d'investissement en général, et d'autres liés à l'investissement étranger.
Cependant, la réalité pratique a prouvé que le rôle du Conseil reste limité dans la promotion de l'investissement, en raison de plusieurs obstacles.
