Abstract EN

This research aims to clarify the relationship of therapeutic and preventive developments to the separation between spouses with infectious diseases.

It consists of an introduction and three sections.

As for the introduction, it presents definitions of the key terms.

The first section deals with the legitimacy of the separation between spouses with infectious diseases and its implications.

The second section is concerned with the therapeutic and preventive conception of AIDS and the realization of the criteria for a number of diseases where a separation between a man and his wife is enforced by the lawgiver.

The third section presents the applications and answers to possible jurisprudential rulings, in addition to a summary of the most important decrees of the Islamic Fiqh Academy and some personal status laws in Arab countries.

The research concludes that Islam's view of the relationship between the sexes is truly sublime.

It also highlights the importance of legislative and legal compatibility with the development of diseases and their treatments.
