Abstract EN
The research aims to discuss the issue of mahram (relative) as a condition for travelling of a woman by plane with the purpose of finding a relative solution to it.
The investigation of this issue has been divided into two sections.
The first section introduces the source of the issue and the jurists’ opinions on it.
The second section provides an explanation of the issue of mahram through focusing on its intentional dimension.
As a result, the analytical method was adopted in this investigation.
The results reveal that the issue of travelling nowadays takes into account the apparent meaning of the conditional presence of the maham without considering the legal purposes underlying the ban of woman travelling alone, which is security.
Thus, taking into account the text’s legal purposes, a woman can travel when security is available even without the company of mahram.
This conclusion is in line with the opinions of the jurists of the four dominant doctrines.
