أهلية العاقد في القانون المدني اليمني رقم (14)‎ لصادر سنة 2002 م في ضوء المذاهب الفقهية

Abstract EN

This research seeks to study the capacity of the contractor in the Yemeni Civil Law number (14) of 2002, through comparing it with the rulings of the contractor’s legal capacity in the four doctrines of jurisprudence.

The researcher first adopted the jurisprudential viewpoint, and then showed the law’s point of view on each part of it.

The research has been divided into an introduction and two sections.

The first section presents the concept of capacity , and the extent to which it is affected by age.

The second section is concerned with the legal conditions that entitle the contractor to perform certain acts.

We conclude that the laws have varied in determining the legal age, as the age of maturity in the Yemeni Civil Law (Article 50) is “fifteen full years, and if a person reaches it with full possession of his mental faculties to make a rational decision, he becomes wholly eligible to exercise his civil rights ...".

“Special laws may require a higher age at which a person is entitled to exercise or enjoy any other rights”.
