Arabic Abstract

تناولت هذه الدراسة على بيان الخلاف بين عالمين جليلين من علماء المذهب الحنفي وهما: الإمام أبو حنيفة إمام المذهب، والإمام زفر بن الهذيل والذي يُعدُّ الرجل الرابع في المذهب الحنفي، وجاءت حدود الدراسة في باب الزواج في المسائل المختلفة فيها بين العالمين، وركزت الدراسة على تحرير محل النزاع ، وذكر أدلة كل منهما وبيان الراجح بينهما في الخلاف في نظر الباحث.

وخرجت الدراسة بعدة نتائج من أهمها أن عدد المسائل المختلف فيها بين العالمين إحدى عشرة مسألة، وأن الخلاف بينهما خلاف معتد به مبني على أدلة معتبرة شرعاً

English Abstract

This study is based on an explanation of the disagreement between two distinguished scholars of the Hanafischool, namely Imam Abu Hanifa, the imam of the sect, and Imam Zafar bin al-Hudhail, who is considered the fourth man in the Hanafi school of thought.

The conflict between the two worlds, and the evidence of each of them is mentioned, and then the most correct in the dispute in the view of the researcher The study came out with several results, the most important of which are: The number of issues in which there is a difference between the two worlds is10 and that the disagreement between the two worlds is a significant one based on evidence that attracts the eyes of the two scholars.
