Arabic Abstract

جاءت هذه الدراسة لتتناول موضوع تمويل الأوقاف و صوره المعاصرة دراسة فقهية مقارنة حيث تهدف هذه الدراسة إلى بيان الطرق التمويلية للأوقاف عند الحاجة إليه التمويل لإصلاحه أو لتقويته واستثماره، و قد تضمنت هذه الدراسة الحديث عن مفهوم تمويل الأوقاف مفرداً و مركباً، فضلاً عن مصادر هذا التمويل، و أسبابه، و ضوابطه.

و بيان الأحكام الفقهية المتعلقة بتمويل الأوقاف من حكم تمويل الأوقاف بالمال الحرام و أموال غير المسلمين، و ما يتعلق بتعاضد الأوقاف و استبداله، و الاستدانة عليه، و كذلك بيان الصيغ القديمة و المعاصرة لتمويل الأوقاف كالإجارة و ما تفرع عنها من صور قديمة كالحكرة و ما شابهها من الصور المعاصرة.

و خلصت الدراسة إلى عدة أمور من أبرزها : أن الأسباب التي تدعو إلى تمويل الأوقاف هي : سبب إصلاحي متمثل بطروء الخراب و النقص على حاله و عن القيام بواجبه، و سبب استثماري و منه البناء و التوسعة، و طلب إنماء المال.

English Abstract

This study came to deal with the topic of “Awqaf financing and its contemporary forms, a comparative jurisprudential study.” This study aims to show the financing methods of endowments when needed, the funding for its reform or strengthening and investment.

Its causes, and controls.

And an explanation of the jurisprudential rulings related to the financing of endowments from the ruling on financing endowments with haram money and the money of non-Muslims, and what is related to the mutual support and replacement of endowments, and indebtedness on it, as well as an explanation of the old and contemporary formulas for financing endowments such as leasing and the ancient forms that branched from it such as hokra, and similar contemporary forms.

The study concluded several things, the most important of which are: The reasons that call for the financing of endowments are: a reformist reason represented by the occurrence of ruin and shortages as it is and from carrying out its duty, and an investment reason, including construction and expansion, and a request to grow money.
