from this point of view, the legislator set strict procedural rules that may not be violated or abandoned, nor violated their requirements, and set up a penalty for this that was termed null and void.

therefore, invalidity is the penalty incurred by the procedure as a result of its violation or omission of a fundamental rule, and as a result of which it does not produce any legal effect.

accordingly, since the military judiciary has a special nature in the procedures followed before it, the issue of the invalidity of the procedures in the stage of the judicial investigation is a topic that deserves to be concerned and to be studied and to be informed of everything related to it and its effects.
