Abstract EN

Through this subject, we aim to study the conception of the formation of the Constitutional Court in Algeria in the light of the constitutional amendment of 2020, by clarifying the controls sponsored by the constitutional founder in his formation, so that the Constitutional Court has the greatest degree of independence in a manner which enables it to perform its functions to the fullest, as well as the independence of its members in a manner which helps them in accomplishing their mission with confidence and assurance.

The independence of the Constitutional Court appears in the context of its formation, through the statement of the mechanisms for appointing and electing members of the Court, their number, the term of their membership and the conditions to be met, and the necessary and required qualifications in selecting its members to enable them to carry out their duties professionally in accordance with the Constitution, with complete impartiality and without exposing them to the possibility of directly submitting to unjust pressures.
