Abstract EN

The electoral system in any country is considered as one of the basic criteria for the study of the democratic orientation of the state.

In order to preserve the electoral system, states seek to protect it on the penal plane by extending control over all electoral stages and thus embody formal and substantive penal protection similar to the criminalization of acts that affect the will of the voter as it is the essence of the freedom of voting, and this is implemented via the Fundamental Law No.

2101-of 10 March2021 related to the election system.

From this point of view, thispaper aims, through a descripitiveand analytical approach, to highlight the importance of electoral processon the one hand, the type of electoralsystem applied in algeria and the extentto which it enjoys conservatism protection on the other hand, where Algeria adopted the proportional representatio system as a democratic system, and the supervision of the voting process was extended through the Independendent National Election Monitoring Authority.
