Abstract EN

This study aims to highlight the importance of extradition for international judicial cooperation.

actually, extradition overlaps with human rights concerns, so lot of problems arises such as : political asylum ; nationals ; death penalty and political crimes.

the central question is about the extent to which it possible to find a common ground for states' interests to fight against transboundary crimes or would extradition remain a controversial issue ? the study concluded that it is necessary to overcome these obstacles by extending the principle of extradite or prosecute, which was emphasized by the United Nations convention against transnational organized crime, to include all crimes, so that its application should not be limited to citizens, but also to include political refugees.

finally, in light of globalization, it is to be questioned whether there is room to invoke human rights and national sovereignty to avoid impunity for criminals ?
