Arabic Abstract

تناولت هذه دراسة مخالفات البلقيني للمذهب الشافعي في بابي النكاح و الطلاق حيث تعرض لبعض مسائل النكاح و الطلاق، مظهرا المخالفات في المسائل التي بين فيها الإمام البقليني رأياً، مخالفا للمذهب الشافعي، و مناقشة الأدلة الشرعية في كل مسألة ثم ترجيح ما يراه الباحث راجحاً و قد قسمت الدراسة إلى خمسة فصول على النحو الآتي : الفصل الأول : تناول مقدمة الدراسة و أهميتها.

و الفصل الثاني : تناول المذهب الشافعي (اسم) الإمام و ولادته، كتابه، و لقبه، و كنيته، شیوخه تلاميذه مصنفاته، التعريف بكتاب التدريب في الفقه الشافعي، التعريف بالمذهب الشافعي).

و الفصل الثالث : تناول مخالفات البلقيني للمذهب الشافعي، حيث شمل مبحثين : المبحث الأول : مفهوم النكاح و حكمه و المبحث الثاني : مسائل في مخالفات البلقيني للمذهب الشافعي في باب النكاح و هي تزويج السفيه المحجور عليه تعليق الزواج على شرط يفيد التحقيق، و عورة المرأة المسلمة بالنسبة للأجنبية الكافرة).

الفصل الرابع : تناول مسائل مخالفات البلقيني للمذهب الشافعي في باب الطلاق، و قد شمل مبحثين : المبحث الأول : مفهوم الطلاق و المبحث الثاني : مسائل في مخالفات البلقيني للمذهب الشافعي في باب الطلاق، و هي الاستثناء بالمشيئة الإلهية في الطلاق، و طلاق السكران و تجزئة الطلاق و الإكراه على الطلاق، و المخالعة على مال، و ثبوت نسب ولد الأمة.

و ذكرت الخاتمة في آخر البحث.

و لتحقيق هذا الهدف اتبع الباحث المنهجين الوصفي التحليلي، و الاستنباطي و الاستقرائي، و قد توصلت الدراسة إلى نتائج تتمثل في عرض المسائل و تقديم الرأي الراجح منها، كما و أوصى الباحث إلى ضرورة توجيه الأنشطة البحثية إلى دراسة الموضوعات الفقهية التي تناولها علماؤنا بما فيهم شيخ الإسلام البلقيتي.

English Abstract

This research deals with Iman Al-Balkini’s opposing views of the Shafi’i doctrine regarding issues on chapters dealing with marriage and divorce, with a detailed analysis of each issue, followed by discussions of what the researcher deems correct—after deducing and discussing the legal evidence in each issue.

The study is divided into five chapters as follows: The first chapter consists of the introduction and the importance of the study; the second chapter deals with the Shafi'i school of thought, with a focus on the Imam’s biography, his mentors and students, his book, in addition to an overview of both the Training in Shafi’i Jurisprudence book and the Shafi’i school of thought.

The third chapter consists of two studies: the first explores the concept of marriage and its laws, while the second examine’s the scholar’s opposing views of the Shafi’i school on marriage.

The fourth chapter consists of two studies: the first explores the concept of divorce, while the second examines the scholar’s opposing views of the Shafi’i doctrine in regards to divorce.

The fifth and last chapter offers conclusions and recommendations.

In order to achieve the research objectives, the researcher adopted both the descriptive analytic and the deductive approaches.

The study results were determined after a discussion of the issues and presenting the most correct opinion.

The researcher emphasizes the need to focus on an scholarly examination of jurisprudential issues addressed by scholars, including works of Sheikh Al-Islam, Al-Balkini.
