Abstract EN

The study aims to analyze the role of the international criminal protection towards the grave crimes committed against the Rohingya Muslims in the (Rakhine) region of the State of Myanmar (formerly Burma).

These crimes include persecution, violence, racial killing, genocide, arson and destruction, ethnic cleansing rape, legislative injustice deportation and forced expulsion, terrorism and intimidation, denial of identity, existence and nationality and other heinous crimes.

The study covered the definition of the Rohingya minority and the scope of criminal protection for them under International criminal law in addition to a careful monitoring of the grave violations they are exposed to, and the conformity of these crimes with those crimes that are included in treaties of the International law, international humanitarian law and international criminal law.

The study followed the descriptive and analytical approach to describe and monitor the challenges facing the Rohingya minority and the role of International criminal protection towards this minority by analyzing the legal texts in International treaties and charters and internal legislation in Myanmar, in addition to extrapolating the facts in the reports of International human rights organizations and contemporary legal studies.

The study reached a set of results; the most important of which is that the Rohingya are indigenous citizens of Myanmar, living in Arkan region for centuries and differing ethnically, religiously and linguistically from the Buddhist majority.

These minorities are facing genocide, forced deportation, murder and crimes against humanity and the legal adaptation of the crimes committed against the Rohingya is described as international crimes that fall under the jurisdiction of the International Criminal Court
