اهتمت الأمم المتحدة "و المنظمات الدولية" و معظم الدول المتحضرة بحقوق الأنسان عامة و بحقوق المرأة بشكل خاص منذ أن اعتمدت الجمعية العامة ل "حقوق الإنسان" في "أول وثيقة دولية لحقوق الإنسان" و التي أكدت على "عدم التمييز ضد المرأة و حماية مصالحها و تمكينها اقتصاديا و اجتماعيا و سياسيا" و الحفاظ على مكانتها في المجتمع، و جعلت يوم (8 مارس / آذار ۱۹۰۸-رمزا لليوم العالمي للمرأة)، و قد صدر "الإعلان العالمي لحقوق الإنسان في العاشر من كانون أول عام 1948".
يمكن القول أن "قضية حقوق المرأة " مجتمعية لا يمكن فصلها عن حقوق الأنسان، و رغم أن القانون العراقي قد ضمن حقها في الصحة و التعليم و في حقوقها "القانونية و الاقتصادية و الاجتماعية و السياسية"، إلا أنها منذ النشأة الأولى لتاريخ دولة العراق السياسي و الاجتماعي تناضل لأجل أن تثبت "حقوقها السياسية و المدنية و الاجتماعية" كمواطنة و كإنسانة، فإن تمكينها و تحررها من كافة أشكال العنف و تنمية قدراتها في مشاركة الرجل في التعليم و العمل على تحسين مستواها المعيشي.
تضمن البحث مباحث ثلاثة، تناول المبحث الأول مفاهيم ورد ذكرها في البحث بمجال حقوق الأنسان و المرأة في "القوانين و الاتفاقيات الدولية لحقوق الأنسان و المرأة"، و في المبحث الثاني التطور التاريخي لحقوق و مكانة المرأة في "الشريعة الإسلامية" و حقوق الإنسان و المرأة في المجتمع الحديث.
أما المبحث الثالث، تم البحث في المعاهدات و المواثيق الدولية الخاصة بحقوق المرأة، و اتفاقية القضاء على أشكال التمييز ضد المرأة.
و في المبحث الرابع (خاتمة البحث)، وجدنا أن تهميش المرأة لا زال قائما، و غياب حقوقها السياسية و الاقتصادية و الاجتماعية لا سيما مساواتها بالرجل فكان على واضعي القرارات رسم سياسات و أحداث تغييرات نوعية في إطار قانوني شامل في الثقافات القائمة و "القضاء على التمييز ضد المرأة" و النهوض بواقعها و حماية حقوقها.
Abstract EN
The united nation, international organizations and most civilized countries have been "concerned with human rights and women's rights in particular in order to protect their interests and empower there economically, politically, and socially although the low have guarantees her right to health and education, legal, economic, and social political rights.
since the inception of the political and social history of state in Iraq, women have struggled to establish and achieve their political, civil and social rights as citizens as humans.
the issue of women's rights is societal and cannot be separated from the progress of society and human rights and the law has guaranteed their inferiority in education and their legal, economic, social and political rights.
as advancing for her rights as a citizen, empowering women and liberating them from all forms of violence, developing their readers, their participation with men in work and education, improving their standard of living and raising their position in assuming the highest positions.
the research included three sections, the first section dealt with concepts and terms mentioned on human rights and women's, explanation discrimination against women with what included in international human law and international humanitarian law.
in the third section (search conclusion), women still suffer marginalization, absence of equality with men in their legitimate social, political, economic rights.
a qualitative change must be made in cultures to divide and eliminate discrimination against women and formulate policies to advance their reality.
