Arabic Abstract

هدفت الدراسة لبيان الأبعاد السياسية و القانونية لضمانات السيادة الأردنية لمنطقتي الباقورة و الغمر، و ضم اسرائيل لأراضي الغور الاردنية و أثرها على مستقبل العلاقة الأردنية الإسرائيلية، و لغايات تحقيق أهداف الدراسة و الإجابة عن تساؤلاتها تم استخدام المناهج التالية : منهج صنع القرار و المنهج القانوني و المنهج الاستقرائي و منهج تحليل النظم، و أجراء مقابلات مع سياسيين أردنيين، حيث سعت الدراسة للإجابة عن التساؤل الرئيس التالي : ما الأبعاد السياسية والقانونية لضمانات السيادة الأردنية لمنطقتي الباقورة والغمر و تأثير محاولات إسرائيل لضم الاغوار و أثرها على مستقبل العلاقة الأردنية - الإسرائيلية.

و خلصت الدراسة الى أن أبعاد السيادة الأردنية السياسة على منطقتي الغمر و الباقورة قد تحققت من خلال الإجراءات السياسة التي اتبعتها الحكومة الأردنية لاسترجاع المنطقتين، و أن الضمانات القانونية للسيادة تتمثل في الالتزام الأردني والاسرائيلي ببنود معاهدة السلام الأردنية الإسرائيلية الموقعة في وادي عربة عام 1994، و أن أهم الآثار القانونية المترتبة على عودة منطقتي الباقورة و الغمر يتمثل في ممارسة الدولة الأردنية لكافة أشكال السيادة القانونية والسياسية على منطقتي الغمر والباقورة، و أن سيطرة قوات الاحتلال الاسرائيلي على اراضي الضفة الغربية بما فيها الاغوار (الفلسطينية) هو خرق لأحكام القانون الدولي و يشكل تهديداً للأمن الوطني الاردني، و سيكون له تأثير مباشر على مستقبل العلاقات الاردنية – الاسرائيلية ، و في ضوء نتائج الدراسة فإنها توصي بإعادة النظر في مجمل العلاقات و الاتفاقيات الأردنية مع اسرائيل، التي أظهرت عبر طرحها لصفقة القرن و خطة الضم الاسرائيلي تغييباً للمصالح الوطنية الأردنية، و عدم احترام للاتفاقيات و المعاهدات الأردنية - الاسرائيلية، و ضرورة تعزيز التنسيق بين الأردن و الجانب الفلسطيني، على أعلى مستوى ممكن، لمواجهة خطة الضم و صفقة القرن في إطار عملية تكامل للأدوار بين الطرفين تحقق المصلحة المشتركة.

English Abstract

This study aims to clarify the political and legal dimensions of the Guarantees of Jordanian sovereignty over the Baqura and Al-Ghamr regions, and Israel's annexation of the Jordan Valley and its impact on the future of the Jordanian-Israeli relationship.

In order to achieve the objectives of the study and answer its questions, the following approaches were used: Decision-making approach, legal approach, inductive approach, systems analysis approach, and conducting interviews with Jordanian politicians.

Where the study sought to answer the main following question: What are the political and legal dimensions of the Guarantees of Jordanian sovereignty of the Baqura and Al-Ghamr regions, and the Israeli attempts to annex the Jordan Valley and its impact on the future of the Jordanian-Israeli relationship? The study concluded that the dimensions of the Jordanian political sovereignty over the Al-Ghamr and Al-Baqoura were achieved through political measures, which the Jordanian government followed to restore the two areas, that the legal guarantees of sovereignty are represented in the Jordanian and Israeli commitment to the provisions of the Jordanian-Israeli peace treaty signed in Wadi Araba in 1994, that the most important legal effect of returning the two districts of Al-Ghamr and Al-Baqoura is that the Jordanian state exercises all forms of legal and political sovereignty over the regions of Al-Ghamr and Al-Baqoura , that the Israeli control over the West Bank, including the (Palestinian) Jordan Valley, is a violation of the provisions of international law and constitutes a threat to the Jordanian national security, and It will reflect a direct impact on the future of Jordanian-Israeli relations.

In light of the results of the study, it recommends a review of all Jordanian relations and agreements with the Israel.

Which showed through its dealing with the deal of the century and the annexation of Jordan valley plan, a clear disregard of the Jordanian national security interests, an intentional violation of the agreements and treaties concluded with Jordan, and the need to strengthen coordination between Jordan and the Palestinian side, at the highest possible level, to confront the annexation plan and the deal of the century, within the framework of a process of integrating roles between the two parties that achieves common interest.
