أصدرت الدولة الجزائرية منذ الاستقلال الكثير من القوانين المتعلقة بالاستثمار أفرزت أساليب متناقضة لمعالجة إشكالية الاستثمار الخاص، و هذا ما انعكس على وضع التنمية الوطنية، فما زالت معدلات النمو الاقتصادي و التكنولوجي متواضعة أمام واقع ارتباط موارد الخزينة العمومية إلى حد كبير بمداخيل البترول، و هو ما يستدعي القيام بإصلاحات جدرية في هذا المجال.
يهدف هذا البحث إلى التعريف بمختلف التشريعات المتعلقة بالاستثمار و بيان الآثار الاقتصادية المترتبة عليها و معالجة إشكالية عدم الاستقرار القانوني في هذا المجال، و تقديم مقترحات بذلك
Abstract EN
Since independence, the Algerian state has issued many laws related to investment that have produced contradictious methods to deal with the problem of private investment, and this is reflected in the situation of national development.
Economic and technological growth rates are still modest in light of the fact that public treasury resources are largely linked to oil revenues, which implies major reforms.
This research aims to introduce the various investment-related legislations, explain the economic implications thereof, deal with the problem of legal instability in this field, and to present appropriate proposals
Abstract FRE
Depuis l’indépendance, l’Etat algérien a publié de nombreuses lois relatives à l’investissement qui ont produit des méthodes contradictoires pour faire face au problème de l’investissement privé, ce qui se reflète dans la situation du développement national.
Les taux de croissance économique et technologique restent modestes compte tenu du fait que les ressources du Trésor public sont largement liées aux recettes pétrolières, ce qui implique des réformes majeures.
Cette recherche vise à introduire les différentes législations relatives à l’investissement, à en expliquer les implications économiques, à traiter le problème de l’instabilité juridique dans ce domaine et à présenter des propositions appropriées.
