قاعدة التنازع ترشد القاضي إلى تطبيق إما القانون الجزائري أو تطبيق قانون أجنبي، و تطبيق القانون الأجنبي يطرح مشاكل حقيقية، تتعلق بالمعاملة الإجرائية لتطبيق القانون الأجنبي في قواعد التنازع الجزائرية، سواء من الناحية النظرية لتحليل هذه العملية، أو من الناحية العملية من حيث معاملة القانون الأجنبي، معرفة مضمونه و إثبات و جوده، تعارض مضمونه مع القانون الجزائري، رفض الاختصاص (الإحالة)، الغش نحو القانون، و مدى الخضوع لرقابة المحكمة العليا عند تطبيق القانون الأجنبي.
Abstract EN
The rule of conflict requires the judge to apply either Algerian law or a foreign law.
the application of a foreign law poses specific problems, which concerns the procedural treatment of the foreign law in the Algerian rules of conflict of laws, both on the theoretical level of the analysis of this operation, and on the practical level of knowledge of the content of the foreign law and the difficulty of determining or knowing the foreign law, the incompatibility of its content with the Algerian law, the dismissal of jurisdiction, fraud against the law and the control of the supreme court

La règle du conflit des lois oriente le juge quant à l’application, soit de la loi Algérienne, soit d’une loi étrangère.
L’application d’une loi étrangère pose de reels problèmes, qui concerne le traitement procédural de la loi étrangère dans les règles de conflit de lois Algérienne, tant sur le plan théorique de l’analyse de cette opération, que sur le plan pratique de la connaissance de la teneur de la loi étrangère et de la difficulté de déterminer ou de connaitre la loi étrangère, l’incompatibilité de son contenu avec la loi Algérienne, le renvoi de compétence, la fraude à la loi et le contrôle de la Cour suprême.
