يتمتع الطفل الذي لا يفهم و لا يتقن لغة البلد المحاكم فيه بحق الاستعانة بمترجم، لكون المترجم حلقة وصل بين الطفل و الضبطية القضائية و كذا جهاز القضاء، نظرا للأهمية البالغة لهذا الحق تم تكريسه في كل من المواثيق الدولية و المواثيق الإقليمية.
تتحقق حماية حق الطفل في الاستعانة بمترجم في التشريع الجزائري، من خلال تحديد علاقة حق الاستعانة بمترجم بحق المحاكمة العادلة و بيان قواعد المسؤولية المطبقة علي المترجم من قواعد المسؤولية التأديبية و قواعد المسؤولية الجزائية.
Abstract EN
A child who does not understand or master the language of the country in which he will be tried has the right to have an interpreter; given that the translator is a link between the child and the judicial police, as well as the judiciary.
due to the extreme importance of this right, it has been consolidated in both international and regional charters.
in the Algerian legislation the protection of the child's right to have an interpreter is achieved by specifying the relationship of the right to a translator with to a fair trial, and a statement of the liability rules applied to him from the rules of disciplinary responsibility and the rules of criminal liability.

Un enfant qui ne comprend pas ou ne maîtrise pas la langue du pays dans lequel il sera jugé a le droit à un interprète ; du fait que ce dernier est un lien entre l'enfant et le greffe du tribunal ainsi qu’avec l’appareil judiciaire.
Compte tenu de la grande importance de ce droit, il a été consacré dans toutes les chartes internationales et régionales.
Dans la législation algérienne, la protection du droit de l'enfant à un interprète est assurée en précisant la relation entre le droit à un interprète et le droit à un procès équitable, et en énonçant les règles de responsabilité applicables à l’interprète à partir des règles de responsabilité disciplinaire et des règles de responsabilité pénale.
