The great evolutions of the economic and social relations and their difference from what they were before in most of the modern societies, as well as the strong entry of the electronic process in the contractual field, the growing manifestations of the weakness between the two parties of the contract and the terrible increase of the private legislations, have impacted the contract system.

In this regard, both lawyers and thinkers consider that the contract is in (Crisis) because of the intervention of the legislator through several legislations to make the contract more flexible and adaptable to the requirements of modern developments, and because it remains faithful to the principle of the authority of the will as a concept that define the contract.

but rather only some of its foundations and this is what once again opens up the debate on the substance of the general theory of contract.
