Abstract EN

The present study revolves around a very important matter related to family.

it is the contribution of the jurisprudence of the supreme court in protecting the family.

it cites some applied models in avoiding the conflict between judicial solutions.

this idea was illustrated by the joy of divorce and the compensation for arbitrary divorce, followed by some models in changing jurisprudence due to interest.

the example was the arrangement of the incubation and the separation of couples for defect.

the concluding idea was about citing some applied models in the violation of the national reference with the example of the expense of el-Idda, as well as the expired period of the nursery, in addition to the requirement in the marriage contract.

in these sub-parts, we referred to what was mentioned in Islam and the Algerian law family.

at the end of the whole process, the final findings were discussed.
