Abstract EN

The aims of This research to shed light on the legal status of unaccompanied refugee children in countries of destination, and the content of legal protection established for them in the current international practice.

The methodology of the research was based on three basic axes.

In the first, we dealt with the legal concept of unaccompanied refugee children, the criteria for their eligibility to acquire refugee status, as well as explaining the precarious legal situation that characterizes this category of forced migrants, with a focus on the most important violations they are exposed to.

As a result of the policy of destination countries in dealing with the situation of immigration and asylum, such as administrative detention, arbitrary detention, and forced deportation to their countries of origin, as well as discriminatory and racist treatment of them in detention centers or abroad.

On the other hand, the study in the second axis allowed us to reveal the foundations of the international commitment to protect unaccompanied children, stemming from international rules established in international human rights instruments and in agreements on refugees and the protection of children in general, as well as the commitment to the right of an unaccompanied child to family reunification.

The meeting also covered the identification of the most important international protection mechanisms established for refugee children in the Diaspora in the current international practice, mainly represented by the Committee on the Rights of the Child and the High Commissioner for Refugees, especially through their efforts to define basic standards for the protection of unaccompanied children and follow up on the conditions for their application.

While we devoted the third axis to defining specific legal protection in the current practice of protecting unaccompanied children by focusing on the work and efforts of international protection bodies active in this regard, such as the Committee on the Rights of the Child and the High Commissioner, which we can identify mainly in the initial set of guarantees as well as sustainable solutions to the situation of unaccompanied children, the most important of which are Their right to family reunification, return to the country of origin, settlement and local integration, or settlement in a third country, especially if it guarantees their unification with their families.

Finally, we concluded many results, the most important of which is the ence of an international instrument on protection as a result of the ence of international agreements on asylum or child rights regulating the legal status of refugee children as a whole, and unaccompanied children in particular, and it makes international protection for the rights of this group of refugees.

Scattered in many general texts.

In addition to the lack of an effective international protection system for the status of an unaccompanied refugee child, to activate the rights and measures covered by international protection, especially with regard to his natural right to family unification or to facilitate the process of resettlement in countries of destination.
