Abstract EN

This study deals with the constitutional and legal organization of the largest number of parliamentary blocs as the criterion governing the nomination of the Prime Minister, and the formation of the Council of Ministers in accordance with the provisions of Articles (76) and (81) of the Constitution of the Republic of Iraq for the year 2005, in addition to analyzing the theoretical reality and comparing it with practical and political reality, and that Based on the judicial applications of the Federal Supreme Court, and without losing sight of the evaluation of these decisions, the analysis of the rationale on which it was based, and the extent to which judicial precedents are embraced in determining the term (the largest number of parliamentary blocs) or not, by examining the cases in which the court deviated from Its previous decisions, despite the binding and final force of the decisions of the Federal Supreme Court in accordance with Article (94) of the Constitution, with an indication of the formal and substantive procedures related to the largest number of parliamentary blocs, and the need to make constitutional amendments related to it or not.
