Arabic Abstract

يعتبر مفهوم الأمن الإنساني من المفاهيم التي تتسم بالحداثة على الساحة الدولية، و ظهرت نتيجة لجملة من الأسباب منحته المكانة الرفيعة في ميدان العلاقات الدولية، كونه أصبح الضامن الرئيس المنظومة الحقوق و الحريات الإنسانية، بعد أن أثبتت المفاهيم الأمنية الأخرى عدم قدرتها على النهوض بهما، لاعتماد الأمن الإنساني على الفرد كوحدة أساسية له بالتحليل، إذ إنه يتسع لكافة حقوق الأفراد بما فيها حق التعليم، و الذي يعد من أهم الحقوق الاقتصادية و الاجتماعية التي تكفل للفرد مزيداً من الرفاه و الكرامة و التقدم وتخطي كل ما يهدد أمنه واستقراره.

تناولت هذه الدراسة الإطار الدستوري لمفهوم الأمن الإنساني في حق التعليم، من خلال توضيح شمولي لمفهوم الأمن الإنساني و أثره في حماية و رعاية حقوق وحريات الأفراد، و كذلك دراسة الحق في التعليم الذي من شأنه التأثير إيجابيا على مستويات التمتع بتلك الحقوق و الحريات عبر بحثه في مختلف المواثيق و المعاهدات الدولية، و بيان مدى تقيد الدول بالنص عليه في دساتيرها و قوانينها النافذة، و سبل حماية الحق قضائيا و شبه القضائي.

خلصت هذه الدراسة إلى أن الحق في التعليم هو السبيل للوصول لتحقيق الأمن الإنساني، على الرغم من عدم التفاني دولياً لإبراز المفهوم بفعالية جادة؛ نظراً لما له من شمولية و تكاملية ترى بعض الدول أنه قد يشكل اعتداء على سياستها الخارجية، إلا أن الحق بالتعليم منصوص عليه بأغلب الدساتير و القوانين المحلية للدول، كونه مقياس للتحضر و تقدم المجتمعات، و مع ذلك ما زال يعاني من ضعف في بعض جوانبه كتلك المتعلقة بتمويله و إدارته، كما ظهر أن بعض الدول غير ملتزمة بتنفيذ التزاماتها الناشئة بموجب المعاهدات و الاتفاقيات الدولية الأمر الذي يحتاج إلى إيلاء الموضوع اهتماما أكبر.

English Abstract

Human security concept is one of the concepts characterized by modernity at the international scene, and emerged due to a group of reasons that gave it a high position at the field of international relations as it became the main guarantor for the human rights and freedoms' system after other security concepts proved their inability to support them as human security depends on the individual as a main unit for it in analysis, and as it involves all individuals' rights including the right in education which is one of the most important economic and social rights that guarantee more prosperity, dignity and progress for the individual, as well as overcoming all which threat his/her security and stability.

This study addresses the constitutional frame for the concept of human security in the right in education through a comprehensive clarification for the concept of human security and its impact on protecting and concerning about individuals' rights and freedoms, the study also investigated the right in education that would positively impact the levels of enjoying these rights and freedoms by reviewing them in the various international charters and treaties in addition to explaining the extent to which countries indicate them in their constitutions and laws in force, and the ways to judicially and semi judicially protect these rights the study concluded that the right in education is the way to achieve human security, despite the lack of international dedication to highlight the concept with serious effectiveness, given its comprehensiveness and integrity which some countries view as a threat on their foreign policies.

But this right is indicated in most local constitutions and laws of countries as it is a measure of the urbanization and progress of societies, yet, it still suffers a eakness in some of its aspects such as these related to finance and management, and it was shown that some countries are not committed to implement their obligations in light of the international treaties and agreements, which needs to be given more attention.
