Abstract EN

According to the text of article 1148 of the Egyptian civil code, contractors and architects are granted a concession over the building that they construct, restore or maintain, and to prove this privilege they are required to have been entrusted with the work for which the sums owed to him are claimed, and that this work has increased in value real estate, and this privilege guarantees all amounts owed to contractors or architects, and is returned to buildings, roads, wells, and other construction works, without its impact extending to the land on which it is built, and this concession does not fall on the value of the building, but rather on what increased in the value of the property because of these expenses, and the concession rights of contractors or architects result in the right to advance on the creditors, as well as the right to trace the thing burdened with the right of concession in whatever hands, but this privilege is required to be recorded so that the owner enjoys the right of tracking, and the franchise rights of contractors or architects expire for several reasons, including destruction of the property, relinquishment of the creditor from the concession, union of liability, clearance and forced sale.
