Arabic Abstract

تعد العشائر مؤسسات اجتماعية قائمة بحد ذاتها و تنهض بالعديد من الأدوار داخل المجتمع كتحقيق الأمن، الإستقرار، و العدالة الاجتماعية، إذ إن المجتمع العشائري بدوره قد أفرز أعرافاً قضائية تعد أقوى من النصوص القانونية، و أوجد وسائل لحل النزاعات أكثر فاعلية من الوسائل القانونية فهو منهج متكامل لمحاربة الجريمة.

و كذلك يرى فيه الكثير مكملاً و مسانداً للدولة، بينما يعتقد آخرون أن دوره بات يفوق دور السلطات الرسمية في بعض الأحيان.

و حتى وقتنا الحاضر ظلت القوانين و الأعراف العشائرية قائمة عبر عديد من الموروثات و العادات القديمة التي تعارف عليها الناس بحيث أصبحت دستوراً بينهم، كما أن القضاة العشائريين هم الأمناء القادرون على إعادة التوازن للمجتمع بعد وقوع الجريمة، و ذلك من خلال حل النزاعات و الخلافات و الجرائم.

و من هنا، كان الهدف من هذه الدراسة إلقاء الضوء على قيمة القضاء العشائري و دوره في حل النزاعات الجزائية، و مدى توافق القضاء العشائري مع الأنظمة القضائية لحل النزاعات بالطرق الودية البديلة مثل الصلح الجزائي و الوساطة الجزائية ،و دور القاضي العشائري بما لديه من خبرات و معارف في نشر الأمن والعدالة في المجتمع من خلال محاربة الجريمة و القضاء عليها .

English Abstract

Tribes are social institutions that exist in their own right and play many roles within society such as security, stability and social justice, as the tribal society in turn has produced judicial customs that are stronger than legal texts, and created means to resolve disputes more effectively than legal means, it is an integrated approach to fighting crime.

He also sees it as complementary and pro-state, while others believe that his role is sometimes greater than that of official authorities.

To this day, tribal laws and customs have existed through many of the old traditions and customs that people have become familiar with, and tribal judges are the secretaries who are able to rebalance society after the crime, through the resolution of disputes, disputes and crimes.

From here, the purpose of this study was to shed light on the value of the tribal judiciary and its role in resolving criminal disputes, and the extent to which the tribal judiciary is compatible with the judicial systems to resolve disputes through alternative friendly methods such as criminal reconciliation and criminal mediation, and the role of the tribal judge with his expertise and knowledge in spreading security and justice in society by fighting
