Arabic Abstract

هدفت الدراسة إلى تحديد المقصود بعمليات نقل الدم من خلال استعراض التطور الذي لحق بعمليات النقل وزراعة الأعضاء البشرية ومعرفة متى يكون الفعل مباحا ومتى يكون محظورا بعمليات نقل الدم إضافة إلى تحديد الشروط والضوابط القانونية اللازمة لانعدام أو قيام المسؤولية الجزائية عن عمليات نقل الدم الملوت.

وسد النقص ما أمكن بخصوص تنظيم عمليات نقل الدم والمسؤولية الجزائية الناجمة عنه في القانون العراقي وذلك مقارنته بالقانون الاردني وغيره من التشريعات المقارنة متى استدعت ضرورة البحث ذلك، ولذلك تم من خلال هذه الدراسة تناول المسؤولية الجزائية من جوانب عدة، حيث بينا من خلالها ماهية عمليات نقل الدم، وتطرقنا أيضاً إلى جوانب مسؤولية الطبيب الجزائية عن عمليات نقل الدم المعيب وأساس المسؤولية الجزائية لبنك الدم عن عمليات نقل الدم المعيب بصفته المكان الذي تحفظ بها الدماء المتبرع بها ويتم نقلها إلى المريض.

وبناءً على ما سبق توصل الباحث إلى مجموعة من النتائج كان أهمها أن عملية نقل الدم قد تشكل اعتداء على الحق في الحياة أو الحق في سلامة الجسد، إذا لم يراع الطبيب المكلف بمهمة أخذ الدم من جسد المتبرع الحصول على الرضاء الحر والمسبق من المتبرع المتبصر الكامل الأهلية، أو إذا لم يحصل الطبيب المعالج أو الجراح على موافقة المريض قبل إجراء عملية نقل الدم كعملية أصلية أو ثانوية ضمن التدخل الجراحي، وضرورة أن يسبقه تبصير وإفهام متلقي الدم بطبيعة نقل الدم بوصفه علاجا مقترحا.

كما قدمت الدراسة العديد من التوصيات كان أهمها ضرورة إصدار قانون خاص للمراكز المتخصصة في نقل الدم وتخزينها وأن تكون حاصلة على التراخيص القانونية مع ضرورة خضوعها للأشراف والرقابة المستمرة مع إتباع تعليمات صارمة بخصوص الدم المستورد من خارج العراق.

English Abstract

The study aimed to determine what is meant by blood transfusions by reviewing the development of transfusions and human organ transplantation, knowing when the act is permissible and when it is prohibited in blood transfusions, in addition to determining the legal conditions and controls necessary for the absence or establishment of criminal responsibility for contaminated blood transfusions.

Filling the gap as much as possible regarding the regulation of blood transfusions and the criminal responsibility resulting from it in Iraqi law, by comparing it with the Jordanian law and other comparative legislation whenever the need for research so requires.

Therefore, through this study, the penal responsibility was addressed from several aspects, where we explained the nature of blood transfusions.

Donated and transferred to the patient and based on the above, the researcher reached a set of results, the most important of which were That the process of transfusion of blood may constitute an infringement on the right to life or the right to bodily integrity, if the physician assigned to take the blood from the donor’s body does not take into account the free and prior consent of the fully qualified, informed donor, or if the treating physician or surgeon does not obtain the consent of the patient Before performing a blood transfusion as a primary or secondary operation within the surgical intervention, and the need for it to be preceded by insight and understanding of the blood recipient of the nature of blood transfusion as a proposed treatment.

The study also made many recommendations, the most important of which was the need to issue a special law for centers specialized in blood transfusion and storage, and to have legal licenses with the need for them to be subject to continuous supervision and control while following strict instructions regarding blood imported from outside Iraq.
