يشكل الاتجار بالبشر إحدى الجرائم التي تتصف بدرجة بالغة من الخطورة، على الصعيدين الدولي و الوطني، و تتفاقم خطورة هذه الجريمة في حالة ارتكابها من جماعات إجرامية منظمة، وبالنظر لذلك فقد اختصها المشرع الدولي باتفاقية خاصة لمواجهتها، هي بروتوكول منع و قمع و معاقبة الاتجار بالأشخاص، و خاصة النساء و الأطفال، المكمل لاتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية لعام 2000، الذي بموجبه جرت دعوة الدول الأطراف فيه إلى اتخاذ الآليات المختلفة للتصدي لها وردعها، ولاسيَّما عن طريق التدابير التشريعية بهذا الخصوص.
و قد تصدى المشرع في العراق لهذه الجريمة باتخاذ عدد من الإجراءات المناسبة، و بضمنها إصدار قانون مكافحة الإتجار بالبشر رقم (28) لعام 2012، الذي تضمن تجريما و عقابا لها، ونص على تشديد العقاب عنها ارتباطا بعدد من الظروف المشددة، ومنها حالة ارتكابها من جماعة إجرامية منظمة.
و يسلط البحث الضوء على بيان مفهومي الاتجار بالبشر والجماعة الإجرامية المنظمة، و مواجهة جريمة الاتجار بالبشر في حالة ارتكابها من جماعة إجرامية منظمة على أساس القوانين العراقية النافذة، و بخاصة قانون مكافحة الاتجار بالبشر رقم (28) لعام 2012، و يتضمن عددا من الاستنتاجات و التوصيات لغرض تطوير التشريعات العراقية ذات الصلة.
English Abstract
Human trafficking is one of the most dangerous crimes at the international and national levels.
The danger of this crime is compounded if it is perpetrated by organized criminal groups.
In this regard, the international legislator has adopted a special convention to combat it, namely, the U.N.
Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, Supplementing the United Nations Convention Against Transnational Organized Crime, according to which states - participants were encouraged to use various mechanisms to address and deter them, especially through legislative measures in this regard.
The Iraqi legislator has fought this crime with many relevant measures including the adoption of the Anti-Trafficking in Persons Act No.
(28) of 2012, which provides for incriminating, punishing, and increasing penalties for it due to some aggravating circumstances including in a case committed by the organization of a criminal group.
The research sheds light on the concepts of trafficking in persons and the organized criminal group and confronting the crime of human trafficking if it is committed by an organized criminal group based on the Iraqi laws in force., especially the Anti-Trafficking in Persons Law No.
28 of 2012, and includes some conclusions and recommendations to improve relevant Iraqi legislation
