Abstract EN

This study aimed to analytically investigate waqf evidence in the UAE from two perspectives: theoretical and practical.

The theoretical component deals with nature of waqf commodity such as transferred waqf, money waqf and intellectual property rights by explaining the relevant Islamic Ruling and the different kinds of the commodity waqf.

The practical component deals with the contemporary evidence in the UAE courts through presenting the documents of waqf evidence and its elements.

The researcher then drew on the elements of this evidence, offered an analytical view of its pillars, and studied the conditions of waqf evidence and the degree of their validity.

The study adopted the descriptive analytical, comparative and inductive approaches, concluding that the conditions of donor in such evidence do not involve any legal violation.
