Abstract EN

This research deals with the issue of documenting endowment (waqf) in writing, by explaining its concept and mentioning the most important terms used to refer to it throughout the ages.

The research also clarifies the legitimacy of documenting endowments in Islam and elucidates the history of documenting endowments in Islam through the ages, in addition to specifying the benefits and outcomes of documentation.

The study also discusses in detail the basic elements that must be met in the endowment document and the complementary elements recommended in it.

In order to support the theoretical study with practical experience, a study of a contemporary endowment document was conducted in this paper, using an analytical as well as a practical method.

In this way, the study would ensure the clarification of the structure, elements, pillars and conditions of (Waqf), in addition to studying the requirements regarding the person who performs it.

One of the most important conclusions reached in this discussion is the importance of attesting and documenting endowments (awqaf) in the present time at the relevant authorities, along with the necessity of involving essential and ancillary components.
