The housing crisis is a major concern in many countries, although there are available areas, many of them are either monopolized or neglected.

The legal usufructuary right in current form in the Kuwaiti Civil Law (Article 944 et seq.) only benefits certain groups and places that are not described as residential; Therefore, the creation of drafting was made - which is what the research concluded – similar to the legal usufructuary right on the one hand and the meaning of the usufructuary right among the majority of Islamic Jurists on the other hand, which is the best solution to this problem, through the expropriation of private property from the monopolist for lands to which public interest related with paying fair compensation; Thus the ownership of such lands transferred to the state, then establishing housing projects for a small amount that would not burden the family, and the beneficiary only used it for housing and use.
