The study presents the problematic of the effectiveness of the legal organization of participatory democracy in Algeria, where the legislator has devoted it in the constitution and the municipal law to ensure citizens in the conduct of local affairs.

However, it remains weakly applied, do to the superficiality and the generality of texts, the ence of basic levels of participation and other shortcomings that limit its effectiveness.
