يعتبر استثمار أراضي الأوقاف الموجهة لاستقبال المشاريع الاستثمارية، أحد أهم التصرفات التي تنمي الوقف و تزيد عوائده، نظرا لأهميتها الاقتصادية و الاجتماعية التي تجعل من مسألة استثماره أمرا حتميا حتى تتحقق أغراض الوقف التي نشأ من أجلها، و هو ما يحققه استثمار أراضي الأوقاف العامة الواقعة في المناطق العامرة أو القابلة للتعمير، غير أن المرسوم التنفيذي رقم 18/213 لم يضبط الأراضي المعنية بالاستثمار، مما يستدعي إعادة النظر في ماهيتها، و ضوابط استثمارها نظرا لـتأثر طبيعتها الاستثمارية في وسائل استثمارها، و هو ما يستهدفه هذا المقال بالبحث و الدراسة
Abstract EN
The investment of Wakfs lands destined for the reception of investment projects is one of the most important actions that develop the wakf and increase its returns, due to its economic and social importance that makes the issue of investing it inevitable until the objectives of the endowment are achieved.
Executive Decree No.
18/213 did not control the lands concerned with investment, which calls for a reconsideration of what they are, and the controls for their investment due to the impact of their investment nature in the means of their investment what this article aims at research and study
